These Terms and Conditions ("Agreement") govern your use of the website at baanrak.world and any legal services provided by Baanrak ("the Firm", "we", "us", "our"), a family law practice registered in Bangkok, Thailand. By accessing our website or engaging our services, you agree to be bound by these terms. If you do not agree, please do not proceed.
1. Definitions
- "Service" means legal advisory and representation services provided by Baanrak.
- "User" / "you" means any person who accesses the website or engages the Firm.
- "Website" means the site operated by Baanrak at baanrak.world.
- "Agreement" means these Terms and Conditions, together with our Privacy Policy and any engagement letter issued to you.
- "Content" means all text, images, documents, and materials on the website.
2. Acceptance of Terms
By submitting a contact form, attending a consultation, or instructing us to act on your behalf, you confirm that:
- You are at least 18 years of age.
- You have the legal capacity to enter into a binding agreement.
- You have read and understood these Terms and Conditions.
3. Description of Services
Baanrak provides legal counsel and representation in family law matters in Thailand, including:
- Divorce and separation proceedings
- Spousal maintenance guidance and negotiation
- Adoption and guardianship applications
Services are provided in Bangkok and, where appropriate, before courts with national jurisdiction. We do not provide services outside Thailand except where we advise on matters with a Thai legal dimension.
4. Client Engagement
A formal engagement begins upon the signing of an engagement letter. The scope, fees, and timeline for each matter are set out in that letter. No work is undertaken and no fees are incurred without prior written agreement.
An initial enquiry or consultation does not constitute an engagement and does not create a solicitor-client relationship unless an engagement letter is signed.
5. User Responsibilities
You agree to:
- Provide accurate and complete information relevant to your matter.
- Notify us promptly of any changes to information you have provided.
- Keep engagement terms and advice confidential where requested.
- Not use our website for any unlawful, fraudulent, or misleading purpose.
- Not attempt to disrupt the operation or security of the website.
6. Fees and Payment
Fees are quoted in Thai Baht (฿). Starting fees for our three service areas are published on the website; final fees for individual matters are set out in the engagement letter.
Invoices are issued at stages agreed in the engagement letter. Payment is due within fourteen days of invoice date. Overdue amounts may incur interest at the rate provided under Thai law.
If you wish to discuss payment arrangements, please raise this before the engagement begins.
7. Intellectual Property
All content on this website — including text, layout, and design — is owned by or licensed to Baanrak. You may view and print content for personal, non-commercial use. You may not reproduce, distribute, or publish website content without our written consent.
8. Confidentiality
We maintain professional legal privilege over all client communications and matter details. We will not disclose information about your matter without your consent, except as required by law or court order.
9. Disclaimers
Information provided on this website is for general guidance only and does not constitute legal advice. Each matter depends on individual facts and applicable law. We recommend seeking specific advice before making any legal decision.
We do not warrant that the website will be uninterrupted or error-free.
10. Limitation of Liability
Our liability to you arising from the provision of legal services is limited to the amount set out in the engagement letter or, where not specified, to the fees paid for the relevant matter. We are not liable for indirect, consequential, or incidental losses.
Nothing in these Terms limits liability for fraud, gross negligence, or any matter that cannot be limited under Thai law.
11. Termination
Either party may terminate an engagement by giving written notice. Upon termination, any fees due for work completed to the date of termination remain payable. We will return your file and documents promptly upon settlement of outstanding fees.
12. Dispute Resolution
In the event of a dispute, we encourage clients to raise concerns with us directly. If a resolution cannot be reached informally, disputes will be subject to the jurisdiction of the courts of Thailand and governed by Thai law.
13. Changes to These Terms
We may update these Terms from time to time. Changes take effect upon publication on the website. Continued use of the website or our services following any update constitutes acceptance of the revised terms.
